General Terms and Conditions
For Sales
A 20% plus 30 SEK fee will be added to the auctioned amount for sales. Items will be listed for sale for 14 days. The seller will receive the payment for the sales proceeds approximately 30 days after the auction ends, provided there are no complaints, and the buyer has paid for the item. Unsold items must be collected within 7 days of the auction; otherwise, Ystads Auctions' responsibility will cease, and Ystads Auctions reserves the right to donate these items to charity. If a customer wishes to withdraw an item submitted for sale, Ystads Auctions reserves the right to charge a fee of 300 SEK, excluding VAT per item.
For Purchases
Placed bids are binding. When purchasing an item, a fee of 22.5% and 40 SEK will be added to the auctioned amount. Collection and payment for purchased items must be made within seven days of the auction's end.
If payment is not received by the due date, a reminder fee of 50 SEK will be charged. If the purchased item is not collected within 7 days, Ystads Auctions reserves the right to charge an administrative fee of 100 SEK and storage fees of 30 SEK per item per day. Ystads Auctions' responsibility for the item will then cease.
If full payment has not been received within 14 days of the auction, Ystads Auctions reserves the right to close the customer's account until full payment is received and to resell the item on behalf of the seller or offer it to the previous highest bidder. For purchased items that have been paid for but not collected, Ystads Auctions has the right to dispose of them by the law on a trader's right to sell uncollected items (1985:982). The right to sell under this law applies three months after the auction ends, once the buyer has received an invoice with a request to collect the purchased item.
No items will be released until payment has been received by Ystads Auctions. All items are sold "as is," and the buyer is responsible for inspecting them to their full satisfaction before bidding. If an item's description contains significant inaccuracies, the buyer may file a claim, which must be submitted in writing within 14 days of receiving the item. The buyer is responsible for any costs incurred in connection with complaints and must return the item in the same condition it was in at the time of sale. Ystads Auctions' liability is limited to the auctioned price of the item and associated fees.
According to the law on distance contracts and contracts outside business premises, buyers have the right to withdraw from purchases made at online auctions, but not if they are business entities. The right of withdrawal does not apply to the sale of bulk goods where individual items, such as coin collections, stamp albums, vinyl records, etc., cannot be distinguished. Nor does the right of withdrawal apply to precious metals such as gold and silver, where market prices may fluctuate. The buyer must notify Ystads Auctions of their intent to exercise the right of withdrawal within 14 days from when the buyer or their representative takes possession of the auctioned item but no later than 25 days after the auction ends.
The buyer is responsible for any costs incurred when exercising the right of withdrawal and must return the item in the same condition it was in at the time of sale. If Ystads Auctions determines that a customer is abusing the right of withdrawal, for example, using it to avoid committing to placed bids, Ystads Auctions reserves the right to close the customer's account without notice.
No functional guarantees are provided for items of a technical nature, such as watches, clocks, electronics, etc. The customers are responsible for inspecting items to their full satisfaction before bidding, which can be done on-site or through a representative. In the event of technical disruptions to the auction system, Ystads Auctions reserves the right to extend the affected auction.
Shipping
The buyer is responsible for transportation costs. Any damages occurring during transport must be resolved between the buyer and the transporter. The buyer may also arrange for an external shipper.
Personal Data
Ystads Auctions collects and processes personal data to the extent necessary to provide its services, identify customers, and fulfil agreements with them. These details will not be shared with unauthorized third parties and will be handled with care in our customer database. Your data will be retained with us as long as you are a customer, and you may request the deletion of your personal data and customer profile. However, following the Accounting Act, we are legally required to retain invoices and records for seven years after the sale.
